Uploading Content on YouTube

If you have a YouTube channel, you may be able to upload Content to the Service. You may use your Content to promote your business or artistic enterprise. If you choose to upload Content, you must not submit to the Service any Content that does not comply with this Agreement (including the YouTube Community Guidelines) or the law. For example, the Content you submit must not include third-party intellectual property (such as copyrighted material) unless you have permission from that party or are otherwise legally entitled to do so. You are legally responsible for the Content you submit to the Service. We may use automated systems that analyze your Content to help detect infringement and abuse, such as spam, malware, and illegal content. You Can only upload content (including music, videos, and artwork) that you created or that you're authorized to use; otherwise, this could result in a copyright violation. Learn more. If you use someone else’s content on your YouTube channel, the copyright owner can submit a takedown request. If this is a valid request, your video will be removed from YouTube and you’ll get a copyright strike. You can wait for a copyright strike to expire, seek a retraction, or submit a counter-notification. If you get three copyright strikes, your channel is subject to termination. Even if there remain videos on the site that appear similar to the one(s) you’ve uploaded, that doesn’t necessarily mean you have the rights to post the content as well. Sometimes a copyright owner authorizes some, but not all, of its works to appear on our site. Other times, very similar videos are owned by different copyright owners, and one may grant permission while another does not. Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant YouTube all of the license rights granted herein.

Removal of Content By YouTube

If we reasonably believe that any Content is in breach of this Agreement or may cause harm to YouTube, our users, or third parties, we may remove or take down that Content in our discretion. We will notify you with the reason for our action unless we reasonably believe that to do so:

  • would breach the law or the direction of a legal enforcement authority or would otherwise risk legal liability for YouTube or our Affiliates;
  • would compromise an investigation or the integrity or operation of the Service; or
  • would cause harm to any user, other third party, YouTube or our Affiliates.

Account Suspension & Termination

If you infringe copyright multiple times, we close your account. If you are in violation of our community guidelines, we may do that immediately. There are no warranties and we are not liable for anything bad that happens when using YouTube. YouTube's policies provide for the termination, in appropriate circumstances, of repeat infringers’ access to the Service. YouTube may suspend or terminate your access, your Google account, or your Google account’s access to all or part of the Service if

  • you materially or repeatedly breach this Agreement;
  • we are required to do so to comply with a legal requirement or a court order; or
  • we believe there has been conduct that creates (or could create) liability or harm to any user, other third party, YouTube or our Affiliates.

Account Termination Policy

1. YouTube will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer.
2. YouTube reserves the right to decide whether Content violates these Terms of Service for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, or excessive length. YouTube may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user's account .

Reasons channels can be terminated:

  • Repeated violations of the Community Guidelines or Terms of Service
  • A single case of severe abuse (such as predatory behavior or spam)
  • Channels dedicated to a policy violation (like hate speech, harassment, or impersonation.

Notice for Termination or Suspension

We will notify you with the reason for termination or suspension by YouTube unless we reasonably believe that to do so:
  • would violate the law or the direction of a legal enforcement authority, or would otherwise risk legal liability for YouTube or our Affiliates;
  • would compromise an investigation or the integrity or operation of the Service; or
  • would cause harm to any user, other third party, YouTube or our Affiliates.

If you create a youtube clone showing your content, especially if you earn money with it.

As part of this continuing innovation, you acknowledge and agree that Google may stop providing the Services (or any features within the Services) to you or to users generally at Google’s sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Google when you stop using the Services. You acknowledge and agree that if Google disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account. Piracykiller works as youtube Affiliates and follow google policies. So it own rights to have access your google account and change settings to manage your account and to remove their clients data. Piracykiller have also the right to terminate or freeze your account (permanently or temporarily) if feel completely violation.

If you believe that your channel was terminated you can appeal for retract using ‘copyright retraction form’.

  • Don’t submit an appeal request more than once. Multiple requests increase the volume to review and cause delays in our response.
  • Fill out the form as completely as possible including your Channel ID. The more information you give us, the easier it will be to process your request.

Governing Law

All claims arising out of or relating to these terms or the Service will be governed by California law, except California’s conflict of laws rules, and will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA. You and YouTube consent to personal jurisdiction in those courts

Next steps

Once we receive this info, we’ll process and forward it to the claimant. The claimant will have 10 business days to provide evidence that they’ve initiated a court action to keep the content down. This time period is a requirement of copyright law,and due to covid19,expect a delay in response, so please be patient.
